The purchase contract is concluded with Tapeten Ewering Raumdesign Inh. Dirk Ewering e.K..
By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods in the shopping cart by clicking on the order button. Immediately after submitting the order, you will receive another confirmation by email.
3. Contract language, contract text storage
The languages available for the conclusion of the contract are German and English.
4. Delivery terms
In addition to the stated product prices, shipping costs are also added. You can find out more about the shipping costs in the offers.
You generally have the option of picking up your order from Tapeten Ewering Raumdesign Inh. Dirk Ewering e.K., Schulstraße 3, 48734 Reken, Germany during the following business hours: Mon-Fri: 8:30 a.m. - 12:30 p.m. and 2:30 p.m. - 6:00 p.m., Sat: 8:30 a.m. - 1:00 p.m.
We do not deliver to packing stations.
5. Payment
Prepayment
If you choose the prepayment payment method, we will give you our bank details in a separate email and deliver the goods after receipt of payment.
PayPal Plus
As part of the PayPal Plus payment service, we offer you various payment methods as PayPal services. You will be redirected to the website of the online provider PayPal. There you can enter your payment details, confirm the use of your data by PayPal and the payment instruction to PayPal.
If you have chosen to pay by credit card, you do not need to be registered with PayPal in order to pay the invoice amount. The payment transaction will be carried out immediately after confirmation of the payment order and after you have been identified as the legitimate cardholder by your credit card company at the request of PayPal and your card will be charged. You will receive further information during the ordering process.
If you have chosen direct debit as your payment method, you do not need to be registered with PayPal to pay the invoice amount. By confirming the payment order, you give PayPal a direct debit mandate. PayPal will inform you of the date on which your account will be debited (so-called prenotification). By submitting the direct debit mandate immediately after confirming the payment order, PayPal will ask its bank to initiate the payment transaction. The payment transaction will be carried out and your account will be debited. You will receive further information during the ordering process.
If you have chosen to pay by invoice, you do not need to be registered with PayPal in order to pay the invoice amount. After a successful address and credit check and the order has been placed, we assign our claim to PayPal. In this case, you can only pay to PayPal with a debt-discharging effect. PayPal's terms and conditions and privacy policy apply to payment processing via PayPal - in addition to our terms and conditions. After placing your order, you will be redirected to the website of the online provider Sofort GmbH. In order to pay the invoice amount via Sofort, you must have an online banking account with PIN/TAN procedure that is activated for participation in Sofort, identify yourself accordingly and confirm the payment instruction to us. You will receive further information during the ordering process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.
Amazon Pay
During the ordering process, you will be redirected to the website of the online provider Amazon before completing the order process in our online shop. In order to complete the order process and pay the invoice amount via Amazon, you must be registered there or register first and authenticate yourself with your access data. There you can select the delivery address and payment method stored by Amazon, confirm the use of your data by Amazon and the payment instruction to us. You will then be redirected back to our online shop where you can complete the order process. Immediately after the goods have been dispatched, we ask Amazon to initiate the payment transaction. 6. Retention of title
The goods remain our property until they have been paid in full. The following applies to entrepreneurs: We retain title to the goods until all claims from an ongoing business relationship have been settled in full. You may resell the reserved goods in the ordinary course of business; you assign to us in advance all claims arising from this resale in the amount of the invoice amount - regardless of whether the reserved goods are combined or mixed with a new item - and we accept this assignment. You remain authorized to collect the claims, but we may also collect claims ourselves if you do not meet your payment obligations.
7. Transport damage
The following applies to consumers: If goods are delivered with obvious transport damage, please complain about such errors to the deliverer as soon as possible and contact us immediately. Failure to complain or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you will help us to assert our own claims against the freight carrier or transport insurance.
The following applies to entrepreneurs: The risk of accidental loss and accidental deterioration passes to you as soon as we have delivered the item to the forwarding agent, the carrier or the other person or institution designated to carry out the shipment. Among merchants, the obligation to inspect and give notice of defects as set out in Section 377 of the German Commercial Code applies. If you fail to give notice as set out there, the goods are deemed to have been approved, unless the defect was not apparent during the inspection. This does not apply if we have fraudulently concealed a defect.
8. Warranty and guarantees
Unless expressly agreed otherwise below, the statutory liability for defects applies. For consumers, the limitation period for claims for defects in used items is one year from delivery of the goods. For entrepreneurs, the limitation period for claims for defects is one year from the transfer of risk; the statutory limitation periods for the right of recourse under Section 478 of the German Civil Code remain unaffected. In relation to entrepreneurs, only our own information and the manufacturer's product descriptions that were included in the contract are deemed to be an agreement on the quality of the goods; we accept no liability for public statements made by the manufacturer or other advertising statements. If the delivered item is defective, we will initially provide a warranty to entrepreneurs at our discretion by removing the defect (repair) or by delivering a defect-free item (replacement delivery). The above restrictions and shortened deadlines do not apply to claims based on damage caused by us, our legal representatives or vicarious agents
- in case of injury to life, body or health
- in the event of intentional or grossly negligent breach of duty and fraudulent intent
- in the event of breach of essential contractual obligations, the fulfilment of which makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner can regularly rely (cardinal obligations)
- within the framework of a guarantee promise, if agreed
